Roosevelt Gang Members Sentenced for Armed Robbery of Uniondale Supermarket

Brothers Devance and Terrell Broyles stole approximately $1,200

MINEOLA, N.Y. – Nassau County District Attorney Madeline Singas announced that two Roosevelt brothers, who are both members of the Bloods gang, have been sentenced for their roles in an armed robbery of a Uniondale supermarket in July 2014.

Devance Broyles, 28, and his brother, Terrell Broyles, 26, pleaded guilty to Robbery in the 1st Degree (a B violent felony), Criminal Use of a Firearm in the 1st Degree (a B violent felony) and Robbery in the 2nd Degree (a C violent felony) on March 15 before Court of Claims Judge Philip Grella.

Devance Broyles was sentenced today to 12 years in prison with five years of post-release supervision, while Terrell Broyles was sentenced on May 3 to 10 years in prison with five years of post-release supervision. Both defendants were sentenced by Judge Grella.

“The defendants terrorized a shop owner by sticking a gun in her back and then pistol-whipping her,” DA Singas said. “Thanks to great police work and to our prosecutors these dangerous gang members will now be off the street for many years to come.”

DA Singas said that on July 25, 2014, at approximately 4:50 p.m., the defendants entered a Uniondale supermarket. Devance Broyles approached the counter with a bag of bread. Then, armed with a gun, he pushed the weapon against the storeowner’s back and forced the owner behind the counter and demanded money from the register. When the owner didn’t open the register, Devance hit the woman in the head with a gun. Terrell Broyles then took a pouch of money that was next to the counter which contained approximately $1,200 cash and fled the scene. The defendants were wearing sunglasses and what appeared to be shower caps during the robbery, which was caught on video.

Fingerprints on the bag of bread led Nassau County Police Department members to Devance Broyles, who was arrested in Roosevelt on November 9, 2014. Terrell Broyles was arrested at a relative’s apartment on April 9, 2015, also by members of the NCPD.

Queens Man Indicted for November Home Invasion

Keno Jamell Ramsay, 19, was arraigned today by Acting Supreme Court Justice Meryl Berkowitz on the following indictment charges:

• Two counts of Burglary in the 1st Degree (a B violent felony)
• Attempted Robbery in the 1st Degree (a C violent felony)• Burglary in the 2nd Degree (a C violent felony)
• Attempted Robbery in the 2nd Degree (a D violent felony)• Assault in the 2nd Degree (a D violent felony)
• Criminal Possession of a Weapon in the 4th Degree (an A misdemeanor)

Bail was set at $150,000 cash or bond. Ramsay, who pleaded not guilty, faces up to five to 25 years in prison if convicted on the top charge. He is due back in court Jan. 19.

“The victim was sleeping comfortably in his bed when this defendant allegedly broke into the home and woke the victim by slapping him in his chest and later hit him with a blunt object,” Acting DA Singas said. “Home invasions are some of the most frightening crimes we deal with as prosecutors and I thank our partners in the Nassau County Police Department for apprehending the suspect as quickly as they did.”

Acting DA Singas said that at approximately 9:45 p.m. on Nov. 10, the defendant allegedly entered a Uniondale home through a rear basement window. Ramsay removed miscellaneous decorations from inside the home and placed them outside on the ground, near the window. The defendant then went to a bedroom where the victim was sleeping and slammed his hands into the victim’s chest. Ramsay demanded food and money from the victim and the two began to struggle. The defendant picked up a blunt object and began swinging it at the victim and hit the man.

The victim called to his 15-year old son who then called police. The victim, who suffered injuries to his chest and arms, was eventually able to subdue Ramsay until the police arrived.

The defendant was then arrested by Nassau County Police Department 1st Precinct officers.

Ramsay currently has another active case in Nassau, in which he is charged with Assault in the 2nd Degree for a June 11 incident.

County OEM Official Indicted for False Statements on Job Applications

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced that a high-ranking County government official was arraigned today on a 12-count indictment on charges related to false statements he allegedly made on four occasions to attain various County jobs.

Edward Korona, Jr., 53, of Hicksville, was arraigned before Acting Supreme Court Justice Jerald Cater on four counts of Perjury in the 2nd Degree (an E felony), four counts of Offering a False Instrument for Filing in the 1st Degree (an E felony) and four counts of Making an Apparently False Sworn Statement in the First Degree (an E felony). Judge Carter released Korona on his own recognizance. Korona faces a maximum sentence 1-1/3 to four years in prison for the top count and is due back in court on Jan. 8.

At the time of the defendant’s arrest on Oct. 15, Korona was serving as Deputy Commissioner of the Nassau County Office of Emergency Management. His alleged crimes were uncovered during the course of the District Attorney’s investigation into county contracts and the contract approval process. In the context of this investigation, the qualifications and professional background of those involved in the administration of contracts may be subject to review.

“The defendant – on separate occasions in December 2007, February 2010, April 2010 and June 2013 – allegedly lied about a felony conviction on sworn job applications with Nassau County,” Acting DA Singas said. “Integrity in government is paramount and it is a serious offense for a high-ranking official with important responsibilities to repeatedly lie about his or her criminal history.”

Acting DA Singas said that during the course of her office’s ongoing investigation into county contracts and the contract approval process, it was discovered in September that Korona has a prior criminal conviction. An investigation ensued which revealed that Korona allegedly made false statements on four applications to the Nassau County Civil Service Commission between December 2007 and June 2013, while applying for various civil service positions. On each form, Korona allegedly checked off “No” to the question “Except for the above traffic offenses, have you ever been convicted of any violation, misdemeanor, or felony?” (emphasis in original). Korona’s position in the Office of Emergency Management is appointed. He is not accused of any crimes related to contracts.

Assistant District Attorneys Andrew Weiss and Lauren McDonough of Acting DA Singas’ Public Corruption Bureau are prosecuting the case. Korona was represented at arraignment by Scott Banks, Esq.

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced that a Queens man, who was the president of two gas station companies, was arrested today for failing to remit $197,411.34 of collected sales tax.

Ehah Labib, 43, of Glen Oaks, Queens, surrendered to DA Investigators this morning and was arraigned by District Court Judge Darlene Harris on a charge of violating Sales and Compensating Use Tax (Section 1817(g) of the Tax Law) (an A misdemeanor) for the tax year of 2011 to 2012 and faces up to a year in prison and a fine of $10,000. The defendant was released on his own recognizance and is due back in court on Dec. 1.

King of Sunrise, Inc., located at 700 West Sunrise Highway in Valley Stream, and Maspeth Service Station, Inc., at 6090 Eliot Avenue in Queens, were charged with Grand Larceny in the 2nd Degree (a C felony), which carries a sentence of $250,000 fine for each corporation. Additionally, King of Sunrise was charged with one count of Criminal Tax Fraud in the 3rd Degree (a D felony) for the tax year of 2011 to 2012 and Maspeth Service Station was charged with one count of Criminal Tax Fraud in the 2nd Degree (a C felony) for the tax year of 2011 to 2012. The corporations are due back in court on Nov. 24.

The arrest was made after a joint investigation by the NCDA and the New York State Department of Taxation and Finance (NYSDTF), Queens regional office.

“Sales taxes are used to fund public safety and critical infrastructure projects like paving our roadways,” Acting DA Singas said. “When customers make a purchase and pay those sales taxes, they should be confident that the business is doing the right thing and sending that money to the state which in turn sends part of it back to the counties. At a time when Nassau County needs every penny of its tax revenues, the defendant and his partners were using their gas stations to line their pockets with sales taxes paid by the public.”

Acting DA Singas said that Labib, as the responsible party for King of Sunrise and Maspeth Service Station, underreported sales in tax returns submitted on behalf of the two corporations for fiscal quarters beginning Dec. 1, 2008 through and including Nov. 30, 2012. The NYSDTF assessed both the Corporate Tax filing and the State Tax filings and discovered additional monies that were not accounted for in their quarterly sales tax filings. Both companies are gas stations that have had convenience stores connected to them.

The defendant failed to remit of a total of $197,411.34 of collected sales tax to the State of New York. One half of the sales tax collected at the Valley Stream station belongs to Nassau County and a portion of the NYC sales tax collected at the Maspeth station belongs to New York City.

This case is being prosecuted by Assistant District Attorney April Montgomery of Acting DA Singas’ Economic Crimes Bureau. Labib, King of Sunrise and Maspeth Service Station are represented by Nicholas Kaizer and Elizabeth Kase, Esqs.

Queens Couple Arrested in Cross-County Sex Trafficking Case

Zhaowei Yin, 49, and his wife Shuwen Ai, 46, both of Flushing, were arrested by DA investigators this morning and arraigned on the following grand jury indictment charges:

• Five counts of Sex Trafficking (a B felony)• Two counts of Promoting Prostitution in the Second Degree (a C Felony)
• Labor Trafficking (a D felony)• Promoting Prostitution in the Third Degree (a D Felony)
• Unauthorized Practice under NYS Education Law (an E felony)

Nassau County Court of Claims Judge Philip Grella set bail at $250,000 cash or bond. Yin and Ai are due back in court on Oct. 15. They face a maximum sentence of 8-1/3 to 25 years in prison if convicted of the top charge.

A third defendant in the case will be arraigned at a future date.

“Trafficked individuals like the women in this case are the victims of a modern-day form of slavery happening all around us in communities across the country,” Acting DA Singas said. “This is what slavery looks like in 2015. Thanks to the hard work of prosecutors, DA investigators, and the Nassau County Police, we were able to identify, indict, and arrest suspected human traffickers right in our own backyard. We will continue to use every investigative tool and partnership available to us to find human traffickers and hold them accountable.”

“Today’s arrests are the culmination of a joint investigation with the Nassau County Police Department’s Narcotic/Vice Squad and the DA’s Investigators,” Acting Police Commissioner Tom Krumpter said. “Utilizing all resources and skilled personnel we were able to bring these two suspects to justice as they will now be facing significant jail time if convicted of these heinous acts. Their arrests should send a clear message to individuals who prey on those they feel are without a voice.”

“This arrest stems from a meticulous investigation by one of the best human trafficking units in New York,” said Sonia Ossorio, president of the National Organization for Women - New York State. “We thank Acting District Attorney Madeline Singas for showing that it is possible to bring traffickers to justice instead of prosecuting their victims. The Nassau D.A.’s Office is earning the trust of trafficking victims and using those relationships to build investigations. This is exactly what we want District Attorneys’ offices to be doing.”

“With the continued collaboration and participation between The Safe Center and the District Attorney’s Office, we are able to provide services and advocacy to the women who are the true victims of these crimes,” said Sandy Oliva and Cynthia Scott, Co-Executive Directors of The Safe Center.

Acting DA Singas said that between May 2013 and the end of January 2014, the defendants allegedly hired two women responding to ads in Chinese-language newspapers under the guise that they would be expected to perform massages, but then began requiring them to perform sexual services on male customers at two locations: Lucy’s Spa at 300 Hempstead Turnpike in West Hempstead and Panda Foot Spa at 400 Franklin Avenue in Franklin Square. Both locations are now closed.

Investigators found that the women were often forced to sleep at the businesses. While the defendants never paid one victim for the time that she worked at the massage parlor at all, the defendants deducted wages from the other victim for occasional transportation home after work and for sleeping at the location, even though she was forced to stay there. The defendants threatened one of the victims that if she failed to comply with their demands, they would post a naked photograph of her on the Internet and in newspapers. The defendants also threatened the undocumented victim that if she reported them to the police, she would be deported. When one of the victims was subjected to physical violence at the hands of a male customer, the defendants forced her to continue to perform whatever services the customer requested.

Both victims had been arrested and charged during undercover operations by the Nassau County Police Department, and their cases were accordingly handled in the Human Trafficking Intervention Part of Nassau County District Court. During further investigation by investigators and prosecutors from the District Attorney’s Office, in collaboration with members of the Nassau County Police Department Narcotics Vice Squad, it was discovered that the women had been coerced to perform sexual acts and had become the victims of sex and labor trafficking. The charges against the victims were subsequently dismissed, and a wider investigation into their alleged traffickers was launched.

The defendants are believed to have owned now-closed spas and massage parlors in Queens, Nassau, and Suffolk Counties, including at least one currently operating spa in Nassau County. The joint investigation by the District Attorney’s Office and the Nassau County Police Department is ongoing.

The Nassau County Human Trafficking Intervention Part was opened in October 2012 as one of three such pilot courts in New York State, in collaboration with the District Attorney’s Office and as part of the statewide Human Trafficking Intervention Initiative proposed by Chief Judge Jonathan Lippman. The purpose of these court parts is to identify defendants who are charged with prostitution and related offenses as a result of being trafficked, and provide linkages to support services. Those who engage in these services may receive non-criminal dispositions or dismissal of their cases, in an effort by the criminal justice system to recognize these individuals as victims of sex and labor trafficking and end further victimization of this vulnerable population. In Nassau County, the District Attorney’s Office has taken this initiative one step further, and committed to aggressively investigate and prosecute any allegations of human trafficking that came to light as a result of any case that was handled in this part. Today’s arrests are a direct result of that commitment.

The District Attorney’s Office partners with The Safe Center LI, RESTORE NYC, and other service providers to offer programs that combine comprehensive assessments and a variety of supportive services, such as individual and group counseling, shelter and housing assistance, immigration services, medical referrals, and education assistance. To date, Nassau County’s Human Trafficking Intervention Part has handled more than 660 cases, and more than 260 individuals have availed themselves of the opportunities offered by these service providers.

Former School Dean Arrested for Lying About Criminal History in Teaching Application

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced the arrest today of a former Queens school dean who allegedly filed an application with the Uniondale Union Free School District (Uniondale UFSD) that contained false information about his criminal history.

William Rini, 59, of Manhasset, was arraigned this afternoon in front of District Court Judge James Darcy and charged with one count of Offering a False Instrument for Filing in the 1st Degree (an E felony). The defendant was released on his own recognizance and is due back in court on September 22. If convicted he faces a maximum sentence of 1 1/3 to 4 years in prison.

“The defendant is charged with seeking employment as a substitute teacher with a school district but lying about his criminal history,” Acting DA Singas said. “It’s critical that applicants to jobs in schools answer questions honestly and undergo background checks so that we can keep our kids safe from predators. Thanks to the sharp eyes of the Uniondale Union Free School District and its cooperation with our prosecutors, this defendant never made it near a classroom and will be held accountable for his actions.”

Acting DA Singas said that it is alleged that the defendant attended a job fair on July 15, 2014 for substitute teaching positions at the Uniondale UFSD. Rini went to the district’s personnel office on August 5, 2014, and submitted an application for the position of substitute teacher and allegedly indicated that he had never been convicted of a crime in the questionnaire packet. The application contained the question “Have you ever been convicted of a crime?” Rini placed a checkmark on the line indicating “No.”

Rini had previously worked as a dean at Intermediate School 145 in Queens and pleaded guilty on May 5, 2004, to one count of Endangering the Welfare of a Child. Rini’s teaching certificate was revoked by the Commissioner of the New York State Education Department on November 14, 2006.

The defendant’s application as a substitute teacher was denied by the Uniondale UFSD. The school district referred the matter to the Nassau County District Attorney’s Office in October.

Armed Gang Member Sentenced in High-Speed Police Pursuit Through Hempstead and Uniondale

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced the sentencing today of a Uniondale gang member for weapons possession and burglary in connection with a high-speed police chase through the streets of Hempstead and Uniondale in October 2013.

Oralus Sebea, 30, was sentenced today to 3-1/2 to seven years in prison with five years of post-release supervision by Acting Nassau Supreme Court Justice Alan Honorof. Sebea pleaded guilty in April to Attempted Burglary in the 2nd Degree (a D violent felony) and Criminal Possession of a Weapon in the 3rd Degree (a D felony).

“In his attempt to evade responsibility for his criminal actions, this armed gang member put the lives of responding police officers, as well as the lives of other drivers and pedestrians, at risk,” Acting DA Singas said. “I thank the police for their diligent efforts in apprehending this defendant and ensuring that no one was hurt that day.”

Acting DA Singas said that on Oct. 18, 2013, at approximately 5:58 p.m., police observed a 1993 Chevrolet driven by Sebea make a left turn while failing to signal on Fulton Avenue in Hempstead. Police activated their emergency lights and sirens, at which point Sebea increased his speed, reaching over to the passenger side door and pushing out a woman from the automobile.

Sebea led police in a high-speed pursuit through the streets of Hempstead and Uniondale. During the course of the chase, Sebea threw a Tec-9, a .357 revolver, and assorted calibers of ammunition from his moving vehicle.

Sebea stopped on Van Buren Street and led police on a foot pursuit that ended at a residence on Adams Street, where Sebea gained entry without permission or authority in order to evade the police. The defendant subsequently surrendered to members of the Nassau County Police Department.

Police later recovered the Tec-9 on Adams Street. The .357 revolver was never recovered. A M1 carbine rifle was found in Sebea’s vehicle, as well as an empty magazine of ammunition for the Tec-9.

The defendant, a known gang member, had two open bench warrants at the time of his arrest.

Drunk Driver Sentenced After Pleading Guilty to Top Count of Manslaughter 2 for Killing Passenger

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced that a Levittown man was sentenced today to prison for killing his 23-year-old passenger while driving drunk at a speed of 120 miles per hour on the Northern State Parkway in July 2014.

Brian Friedrichs, 23, was sentenced today to four to 12 years in prison by Nassau County Court of Claims Judge Alan Honorof. Friedrichs pleaded guilty in April to Manslaughter in the 2nd Degree (a C felony) and Driving While Intoxicated (an unclassified misdemeanor).

“Once again, a wildly reckless and drunk driver tragically stole the life of his passenger while risking the lives of innocent residents of Nassau County,” Acting DA Singas said. “Friedrichs was drunk and driving 120 mph when he lost control, which should be considered more than simple ‘recklessness’ under the law. Aggravated Vehicular Homicide must be expanded to include gravely risky behavior like this.”

Acting DA Singas said that on July 22, 2014, at approximately 4 a.m., a 2012 Mazda 3 operated by Friedrichs with 23-year-old passenger, Christopher Gallina, crashed while traveling westbound on the Northern State Parkway near the Post Avenue exit. Both Friedrichs and Gallina were ejected from the vehicle after it struck a wall on the shoulder and rolled.

The highest charge he faced was Manslaughter in the 2nd Degree, a C felony with a sentence range between probation and five to 15 years in prison. If the B felony of Aggravated Vehicular Homicide were expanded, Friedrichs would have faced a possible maximum sentence of 8-1/3 to 25 years in prison. Acting DA Singas’ office is continuing to work with our legislative partners to introduce legislation that adds a new subsection to Aggravated Vehicular Homicide making it a B felony to cause the death of someone while driving while under the influence of alcohol or drugs and when the driving is so reckless it creates a grave risk of death to others.

The black box contained within the defendant’s vehicle indicated that the vehicle was traveling 120 miles per hour before losing control. Friedrichs was arrested the same day by the New York State Police, with a blood alcohol content of .14%. Under the current law, the defendant would need to have a BAC of .18 or higher to qualify for and Aggravated Vehicular Homicide charge under these facts. The law recognizes excessive blood alcohol but it should also recognize gross recklessness.

Suffolk Woman Pleads Guilty to Injuring 18-Year-Old in High-Speed, Alcohol and Drug-Fueled Crash

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced that a Wyandanch woman pleaded guilty today for causing serious injuries to an 18-year-old passenger by losing control of a vehicle while high on drugs and alcohol and traveling at an excessive rate of speed on the Meadowbrook Parkway in March 2014.

Keira Corbin, 21, pleaded guilty to Assault in the 2nd Degree (a D violent felony), Driving While Ability Impaired by the Combined Use of Drugs and Alcohol (an unclassified misdemeanor), and Reckless Driving (an unclassified misdemeanor) before Acting Supreme Court Justice Christopher Quinn.

Corbin received a sentencing commitment from Judge Quinn of three years in prison. She is due back in court for sentencing on Sept. 8.

“The combination of alcohol, drugs, using a cell phone and 111 mph speed made this terrible crash inevitable,” Acting DA Singas said. “It is amazing that no one inside or out of the car was killed but the devastating injuries suffered by Ms. Corbin’s passenger should remind everyone to be careful about whom you trust to drive.”

Acting DA Singas said that on March 1, 2014, at approximately 5:20 a.m., Corbin was driving a borrowed 2014 Chevy Cruze at speeds in excess of 111 miles per hour northbound on the Meadowbrook Parkway. The original driver had just exited the car at her home and then gave the car to Corbin to drive.

As she drove at this lethally high speed, Corbin was also using her cell phone. Corbin attempted to exit the Meadowbrook Parkway onto the ramp for the Southern State Parkway, but her excessive speed caused her to lose control of her vehicle, which began to slide – ultimately over 300 feet – off the Meadowbrook Parkway onto a grassy divider between the exit and entrances from the Southern State Parkway.

Corbin’s vehicle slid directly into and through a small tree before it began to roll over. The vehicle flipped over several times and ultimately flipped over a metal guiderail into a wooded area. As the vehicle went over the guiderail, the metal sliced open the car’s roof.

As a result, one of the defendant’s two backseat passengers was seriously injured by the ragged edges of the roof, which essentially scalped the victim and severed a portion of her ear. Corbin’s other passenger, also in the backseat, suffered minor injuries.

In the aftermath of the crash, with her victim unconscious and bleeding from the head in the backseat, Corbin asked concerned citizens who had stopped to assist to not call the police.

Corbin consented to a blood test which revealed a blood alcohol concentration of .17%, as well as evidence of marijuana, and Xanax in her system.

Corbin’s victim is still recovering from her injuries.

Jury Finds Hempstead Murder Defendant Guilty on All Counts

After several hours of deliberation, a jury found Michael Gibson, 35, of Hempstead, guilty today of all counts from his 2012 indictment: Murder in the 2nd Degree (an A-1 violent felony) and two counts of Criminal Possession of a Weapon in the 2nd Degree (a C violent felony). Gibson faces a maximum of 25 years to life in prison at his sentencing before Acting Supreme Court Justice Jerald Carter on July 16.

“This defendant stopped his car, approached a bar fight with a gun drawn, shot and killed a man, then tried to run from his crime,” Acting DA Singas said. “Thanks to the efforts of police and parole officers, and our prosecutorial team, he’ll be held accountable for this senseless violence.”

Acting DA Singas said that on September 3, 2011 at approximately 3 a.m., a group of young men were engaged in a fight outside of Seduccion night club located at 306b Main Street in Hempstead. Gibson arrived by car in the vicinity of the club, circled the block and observed his friends engaged in the fight near the intersection of Main Street and Sammis Place. He parked down the block. He then exited, ran out of the car towards the fight, and raised and fired a gun one time at the group. The victim was shot once in the neck.

Gibson fled the scene immediately, and fled Nassau County.

Gibson’s victim was pronounced dead almost immediately at Winthrop-University Hospital. Gibson was tracked down by the Nassau County Police Department Homicide Squad and arrested by New York State parole officers in North Carolina in December of 2011.

Steven Klein, 62, was arrested by DA investigators and arraigned today on a charge of Grand Larceny in the 3rd Degree (a D felony). Nassau County District Court Judge Paul Meli set bail at $5,000 cash or bond. Klein faces a maximum sentence of 2-1/3 to seven years in prison, and is due back in court on June 5.

“Regardless of whether an investor has known their financial planner for a month, or for decades, I urge everyone to be vigilant about checking their accounts for unauthorized purchases and withdrawals,” Acting DA Singas said. “Financial planners who abuse the trust placed in them by their clients will be held accountable by my office for their crimes.”

Acting DA Singas said that from April 12, 2007 to November 14, 2013, Klein embezzled $25,780 from a trust account in the name of the Daren J. Tuchband Irrevocable Life Insurance Trust, over which he had control as trustee and signatory as a financial planner.

These funds were to have been used to pay insurance premiums on a life insurance policy for Daren Tuchband, who together with her husband, Jerald Tuchband, both of Nanuet, have been friends with Klein since their college days more than 45 years ago.

Instead, Klein transferred this money to his own accounts, principally one that he maintained on behalf of his financial planning business, JASAM Financial. Klein used the stolen funds to pay personal expenses to supermarkets, book stores, pharmacies, and for his automobile lease, LIPA and AOL accounts.

In order to be able to continue paying premiums as they came due on the policy after he had stolen the money, Klein took loans from a life insurance company against the cash surrender value of the policy. These loans, which totaled $11,018.99 plus interest, greatly reduced the value of the policy.

When the Tuchbands discovered what Klein had done, they made numerous unsuccessful attempts to recover their money from him, leading them to file a complaint with the DA’s office.

Assistant District Attorney Peter Mancuso of Acting DA Singas’ Government and Consumer Frauds Bureau is prosecuting the case. Klein was represented at arraignment by the Legal Aid Society.

Acting DA Singas Proposes One-Stop Shop for Victims of Domestic Violence

Working with regional government & non-profit partners to realize dream of Long Island’s first ‘Family Justice Center’

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas has proposed and is working with regional and local governmental and non-governmental partners to create a comprehensive one-stop shop for domestic violence victims that would allow them to receive legal, health, financial and other services in one convenient location next to Nassau County courts, addressing many of the logistical issues that currently make it difficult for victims to get the help they need during domestic violence prosecutions.

“Four New York City boroughs and Westchester County have Family Justice Centers to serve as comprehensive one-stop shops for domestic violence victims, and it's time we provide Nassau County victims with these critical resources in the most efficient and effective way we can,” Acting DA Singas said. “No victim of a crime should have to miss out on the services they need because government failed to coordinate resources, and that's why I’ve made the creation of Long Island’s first Family Justice Center a priority. I'm grateful to County Executive Edward Mangano for his support and commitment to this important project, and I look forward to working with our government and community partners to ensure its success."

Nassau County Executive Edward P. Mangano stated, “I declared Family and domestic violence are public health emergencies that threaten the lives of children and other family members. Since taking office, my administration has worked tirelessly to reduce violence in our communities. The creation of a comprehensive one-stop shop is critical for domestic violence victims to receive assistance and obtain other resources they need to get help.”

What is the problem?
Domestic violence victims can potentially require a very wide range of services to address their abuse. In addition to appearances in County or Supreme Court facilities, victims typically must also meet with prosecutors from the District Attorney’s Office and detectives and other members of the Police Department. Victims may also require the services of government agencies and non-profit organizations providing legal assistance, physical and mental health care, emergency and long-term housing assistance, educational opportunity, employment assistance, financial counseling and other services designed to help provide safety and self-sufficiency to victims.

Right now, a domestic violence victim might have to travel to numerous locations across Nassau County to receive all of the above services. This combined task can be time-consuming, costly, inefficient and dangerous enough – due to the constraints on mobility that domestic violence victims are often subject to by their abusers – to make it difficult for many victims to get all the services they need.

What are the solutions?
In 2014, the Coalition Against Domestic Violence (CADV) and the Coalition Against Child Abuse & Neglect (CCAN) merged into one facility in Bethpage to form The Safe Center, which is also staffed by the District Attorney’s Office and the Police Department. Other services provided at The Safe Center include crisis intervention; individual, child family counseling; legal advocacy; emergency and long-term housing assistance; educational programs; and referrals to other services.

A new, comprehensive Family Justice Center, using similar centers in New York City and Westchester as a model, Acting DA Singas said, would build upon the success of The Safe Center and not just expand services, but also put them all in one building adjacent to Nassau County Court, Supreme Court and Family Court, in Mineola within walking distance to major public transportation lines like the Long Island Rail Road. This ‘one-stop shop,’ which would include day care services for children so that parent victims can attend appointments, would allow victims to dramatically diminish the obstacles of cost, time, and risk of detection by abusers that victims currently face.

“A new Family Justice Center in Nassau County, using similar centers in neighboring counties as a model, would take the great work currently done at The Safe Center and expand it in both scope and scale, making it even easier for victims to get the help they need in one place near Nassau Courts,” Acting DA Singas said.

What has been done so far?
Starting immediately after her swearing in to office in January, Acting DA Singas and her staff have conducted an extensive amount of research and site visits with Family Justice Centers in Queens, Brooklyn, Manhattan and Westchester in order to build her proposal for Long Island’s first such facility. She has met with County officials including County Executive Edward Mangano, New York City officials, and critical non-governmental partners such as The Safe Center and Hofstra Law School, and has also identified alternative funding sources, including federal grant and criminal asset forfeiture funding streams, to neutralize local taxpayer costs for the project. In the days and weeks ahead, Acting DA Singas and her staff will continue courting non-governmental service providers to commit to staffing the new Family Justice Center, whose success will rely upon the active participation of victim service providers.

What exactly would go into Long Island’s first Family Justice Center?
As with the Family Justice Centers in New York City and Westchester, Long Island’s first such facility would serve as an easily accessible, secure, one-stop shop where victims can find legal assistance, physical and mental health care services and referrals, emergency and long-term housing assistance, educational opportunity, employment assistance, financial counseling, child day care, and other services designed to help provide safety and self-sufficiency to victims of domestic violence, family violence, child abuse, elder abuse, and human trafficking.

The Nassau Family Justice Center would be a public-private partnership, and has been proposed to be located at 400 County Seat Drive (the site of the current Nassau County Matrimonial Center), which is approximately one block from County and Supreme Courts, the District Attorney’s Office, and the future site of the Nassau Family Court. The proposed location is within walking distance to the Mineola Long Island Rail Road and NICE Bus station, making accessibility for victims without access to a vehicle easier. The renovation of the Matrimonial Center building for its proposed transition into the Nassau Family Justice Center is expected to be completed in 2017, coinciding with the completion of the renovation of the new Nassau Family Court.

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced that a Baldwin man was sentenced today for a drug and alcohol-fueled hit-and-run that resulted in the death of 49-year-old Donald Mooney in August 2014.

Cosmin Florea, 34, was sentenced today by Acting Nassau Supreme Court Justice Helene Gugerty to the maximum sentence of 2-1/3 to seven years in prison.

Florea pleaded guilty in March to Vehicular Manslaughter in the 2nd Degree (a D felony), Leaving the Scene of an Incident Without Reporting (a D felony), two counts of Driving While Intoxicated (an unclassified misdemeanor), and Driving While Ability Impaired by the combined use of Alcohol and Drugs (an unclassified misdemeanor)

"Mr. Mooney was just crossing the street when he was run down and left for dead by an impaired driver who received 2-1/3 to seven years in prison -- the maximum penalty for fleeing that scene," Acting DA Singas said. “Today I join the Mooney family in calling for the Legislature to finally increase the penalties to a maximum of 5 to 15 years for these cases so the law doesn’t work to encourage drivers to leave.”

Acting DA Singas said that on Aug. 15 at 11:57 p.m., Florea was driving a 2010 Ford Fusion when he struck Mooney, of Lynbrook, who was walking across Main Street west of South Bayles Avenue in Port Washington.

Florea left the scene and was later stopped in Queens by P.O. Wayne Kaifler of the New York City Police Department, who observed damage to the vehicle’s windshield. The driver claimed he had hit a deer. At the time of his plea of guilty, the defendant admitted having a .13 BAC and active marijuana in his blood more than three hours after the crash. Florea was arrested by the Port Washington Police Department with the assistance of Detective James DePierro of the Nassau County Police Department.

Mooney was transported to North Shore University Hospital, where he died from his injuries.

Woman Faces Additional Charges in Hempstead School Assault on Teacher

Annika McKenzie, 34, of Hempstead, was arraigned today on the following grand jury charges before Acting Nassau Supreme Court Justice Jerald Carter:

• Assault in the 2nd Degree (a D violent felony)
• Two counts of Assault in the 3rd Degree (an A misdemeanor)
• Two counts of Criminal Trespass in the 3rd Degree (a B misdemeanor)
• Harassment in the 2nd Degree (a violation)
• Disorderly Conduct (a violation)

Judge Carter continued bail at $7,500 bond or $5,000 cash. McKenzie faces a maximum sentence of to two to seven years in prison. She is due back in court on June 8.

“Violence and disregard for the law should not occur inside any school,” Acting DA Singas said. “My office will continue our efforts to ensure that Nassau classrooms remain safe places for students to learn and teachers to instruct in an environment free from violence of any kind.”

Acting DA Singas said on April 15 at approximately 1:45 p.m., McKenzie, while at the Alverta B. Gray Schultz Middle School in Hempstead, physically assaulted a 58-year-old middle school math teacher, causing her to lose consciousness.

The defendant, who is the mother of a student at the school, committed this crime while acting in concert with a juvenile, whose case is being handled by the Nassau County Family Court.

Acting DA Singas Announces Arrests in Joint Investigation to Combat Food Stamp Fraud

Nassau store owners and employees arrested for food stamp trafficking scheme that federal officials estimate to total $1.3 million

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced charges against food store businesses, owners and employees as a result of a joint investigation that federal officials estimate to total $1.3 million in food stamp fraud.

“Public Assistance programs are supposed to be for people who are struggling to feed themselves and their families, not for store owners and their employees to line their pockets and profit at the expense of taxpayers and the people that need food stamp benefits the most,” Acting DA Singas said. “Food stamp benefits are a lifeline for many Nassau residents, and my office will continue to work with local, state, and federal agencies to make sure this vital program remains fiscally sound. I thank our partners for their invaluable assistance in this case.”

“The Supplemental Nutrition Assistance Program was created to provide food and nutrition to those who truly need this assistance. Those who are involved in fraud and abuse of SNAP and other USDA programs will be aggressively pursued by our office,” USDA Office of Inspector General, Special Agent-in-Charge William G. Squires Jr. said. “Our joint investigation with the Nassau County District Attorney’s Office and Nassau County Police Department has brought to justice several individuals who obtained thousands of dollars from the SNAP program through illegal schemes. The USDA Office of Inspector General will continue to dedicate resources and work with our state and local law enforcement partners in order to protect the integrity of these programs and to prosecute those who commit fraud.”

“My administration works tirelessly with State and Federal agencies to root out waste, fraud and abuse of taxpayer dollars,” said Nassau County Executive Edward P. Mangano. “These arrests should serve as further warning that anyone who cheats our taxpayers will be apprehended and brought to justice.”

Administered by the U.S. Dept. of Agriculture, Supplemental Nutrition Assistance Program (SNAP) benefits are issued to recipients who apply for food stamp benefits through their local Department of Social Services. Once the recipient is deemed eligible for such benefits, an account is opened in the recipient’s name and the recipient is issued an Electronic Benefit Transfer card by SNAP.

According to USDA regulations, retailers who wish to participate in SNAP must apply for a license to redeem food stamps. As part of a retailer’s application for a license, the owner of each location must certify and sign an application which includes language that prohibits trading cash for food stamp benefits and accepting food stamp benefits as payment for ineligible items, such as alcohol or cigarettes.

Happy MiniMarket, Corp., located at 118 N. Franklin St. in Hempstead, and owner, Remigio Betances, 53, of Brooklyn, were charged with Grand Larceny in the 2nd Degree (a C felony), Misuse of Food Stamps, Food Stamp Program Coupons, Authorization Cards and Electronic Access Devices (a C felony) and Falsifying Business Records in the 1st Degree (an E felony). Three current and former employees of the store, Domingo Henriquez, 49, address unknown; Ariel Rey Gonzales, 26, of Brooklyn; and Franklin Diaz, 44, of Hempstead were charged with grand larceny, petit larceny, food stamp fraud and falsifying business records.

A warrant has been issued for Betances’ arrest. Henriquez was released on his own recognizance today by Nassau District Court Judge James Darcy, and is due back in court on May 11. Gonzales is expected to be arraigned tomorrow in 1st District Court, Hempstead. Diaz was issued a desk appearance ticket and is expected to be back in court on May 18.

During the course of an undercover investigation from April 2012 through July 2014, Happy MiniMarket, through its employees, fraudulently charged the food stamp benefits program $3,904.92 in unauthorized transactions, including sales of cigarettes and beer, as well as exchanging benefits for cash.

During the investigation, in one instance a $120 food stamp transaction involving the illegal cashing out of food stamp benefits would include the store giving $60 to an undercover investigator and keeping $60 for itself. On several occasions, investigators were able to present multiple Electronic Benefit Transfer (EBT) cards issued by SNAP, in the names of various individuals, with store employees exchanging U.S. currency for each card, without any authorized food transactions.

In this case, the USDA concluded that the total amount of food stamp trafficking committed by Happy MiniMarket from Jan. 1, 2012 through Dec. 31, 2014 was approximately $439,685.60.

Franklin Street MiniMarket, Inc., located at 235 S. Franklin St. in Hempstead, co-owner Hashim Alzundani, 26, of Uniondale, and co-owner Median Hammud, 36, of East Meadow, were charged with Grand Larceny in the 2nd Degree; Misuse of Food Stamps, Food Stamp Program Coupons, Authorization Cards and Electronic Access Devices; and Falsifying Business Records in the 1st Degree. A clerk at the store, Hector Rivas Molina, 24, address unknown, was charged with petit larceny, food stamp fraud and falsifying business records.

Judge Darcy set bail for Alzundani at $10,000 bond or $5,000 cash. Molina was released on his own recognizance. Both defendants are due back in court on May 11.

A warrant has been issued for Hammud’s arrest.

During the course of an undercover investigation from April 2012 through April 2015, Franklin Street MiniMarket, through its employees, fraudulently charged the food stamp benefits program $2,472.18 dollars in unauthorized transactions, including sales of cigarettes and beer, as well as exchanging benefits for cash.

In one example, for a $113.50 food stamp transaction in which the fraudulent transaction was for money only, an undercover investigator was given $50 and the store kept $50 for itself. The remaining $13.50 was spent on eligible food items. On several occasions, undercovers were able to present multiple EBT benefit cards in the names of various individuals, and the clerks at the location exchanged U.S. currency for each card, without any authorized food transactions.

In this case, the USDA has concluded that the total amount of food stamp trafficking committed by Franklin Street MiniMarket, Inc. since January 1, 2012 is approximately $725,032.95.

Franklin Street Grocery, Inc., located at 171 S. Franklin St. in Hempstead, and owner Sameer Shahin, 51, of North Bellmore, were charged with Grand Larceny in the 2nd Degree; Misuse of Food Stamps, Food Stamp Program Coupons, Authorization Cards and Electronic Access Devices; and Falsifying Business Records in the 1st Degree. A former clerk, Suliman Shahin aka Simon Asfour, 21, of North Bellmore, was charged with petit larceny, food stamp fraud and falsifying business records.

Judge Darcy set bail for Sameer Shahin at $5,000 bond or $2,500 cash. Suliman Shahin was released on his own recognizance by Judge Darcy, and is due back in court on May 11.

During the course of an undercover investigation from April 2012 through April 2015 Franklin Street Grocery, through its employees, fraudulently charged the food stamp benefits program $2,944.50 in unauthorized transactions, including sales of cigarettes and beer, as well as exchanging benefits for cash.

For example, undercover investigators made a $108.54 food stamp transaction in which the fraudulent transaction was for money only, the undercover was given $50 and the store kept $50 for itself. The remaining $8.54 was spend on eligible food items. On several occasions, investigators were able to present multiple EBT benefit cards in the names of various individuals, with store employees exchanging U.S. currency for each card, without any authorized food transactions.

In this case, the USDA has concluded that the total amount of food stamp trafficking committed by Franklin Street Grocery since Jan. 1, 2012 is approximately $202,279.84.

The undercover investigation was coordinated by the DA’s office and the United States Department of Agriculture Office of Inspector General, Investigations and the U.S. Dept of Agriculture Food and Nutrition Services with the assistance of the New York State Office of Temporary and Disability Assistance and Nassau County Department of Social Services Special Investigations.

Roosevelt Man Pleads Guilty to Armed Robbery Spree Targeting Cab Drivers

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced that a Roosevelt man pleaded guilty yesterday to committing a string of armed robberies targeting three taxicab drivers, one of whom was shot, at locations in Hempstead and Roosevelt in August 2013. Additionally, the defendant pleaded guilty to a shooting in Hempstead, also in August 2013, that critically injured a man who needed surgery to remove a bullet lodged closely to his spine.

Ezekiel Pittman, 21, pleaded guilty on Wednesday to two counts of Robbery in the 1st Degree (a B violent felony), Assault in the 1st Degree (a B violent felony), Attempted Robbery in the 1st Degree (a C felony), and Attempted Assault in the 1st Degree (a C felony) before Acting Nassau Supreme Court Justice Helene Gugerty. Pittman received a sentencing commitment from Judge Gugerty of 20 years in prison. He is due back in court for sentencing on June 2.

“Armed with a gun and determined to rob his victims regardless of the consequences, Mr. Pittman targeted four people unlucky enough to get in his way,” Acting DA Singas said. “As a result of his actions, all of his victims have been left with emotional scars, and three of his victims with physical scars that may never fully heal. With this guilty plea, we are ensuring that Mr. Pittman will no longer be a violent menace to our communities for some time to come.”

Acting DA Singas said on Aug. 2, 2013 at about 1:45 a.m., Pittman entered the rear of a cab in the vicinity of 5 Winthrop Street in Hempstead. Pittman displayed a gun and demanded money from the driver. The driver confronted Pittman, who became nervous and fled.

On Aug. 3, 2013 at about 2:22 p.m., Pittman entered the rear of a cab in the vicinity of 57 Willet Place in Roosevelt. Pittman displayed a gun, and demanded money from the driver. When the driver started to go into his pocket for money, Pittman became impatient and hit the driver in the area of his left eye with the gun. The driver gave Pittman approximately $200 and the defendant fled.

On Aug. 10, 2013 at about 7:30 p.m., Pittman entered the rear of a cab in the vicinity of 48 W. Roosevelt Ave. in Roosevelt. Pittman displayed a gun, and demanded money from the driver. After the driver threw $20 at Pittman, the defendant demanded more money, and shot the driver in the side. The driver was released from the hospital the next day with the bullet remaining in in his body.

In a separate case, Pittman approached a male hanging out with a group of friends on Fulton Avenue in Hempstead on Aug. 6, 2013, asking for change and marijuana. Pittman then displayed a firearm and shot the victim in the side, with the bullet causing an injury to the victim’s kidney and lung. A few months later, the victim had to have surgery to remove the bullet because it had lodged closely to his spine.

Pittman was arrested by the Nassau County Police Department on Aug. 10, 2013.

Auto Body Shop Owner Arrested for Stealing Nearly $190K in Sales Taxes

Douglas Donnelly, Jr., 50, of Garden City, failed to remit thousands of dollars in sales tax collected from customers of three Nassau businesses

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced the arrest of a Garden City man for failing to remit sales taxes to New York State by underreporting sales in tax returns submitted on behalf of three auto body shop businesses for which he was the responsible party.

Douglas Donnelly, 50, was arrested and arraigned today before Nassau District Court Judge Darlene Harris on the following charges:

• Grand Larceny in the 2nd Degree (a C felony)
• Four counts of Offering a False Instrument for Filing in the 1st Degree (an E felony)• Three counts of Criminal Tax Fraud in the 3rd Degree (a D felony)

Three corporations for which Donnelly was the responsible party – Mineola-Jericho Auto Body, Inc.; Trinity Auto Body, Ltd.; and Trinity’s Mineola Jericho Auto Body Ltd. – also face larceny and felony criminal tax fraud charges.

Judge Harris released the defendant on his own recognizance. If convicted of the top charge, Donnelly faces a maximum sentence of five to 15 years in prison. He is due back in court on April 16.

“Customers who pay sales tax to businesses should be sure that the money they are spending is going towards vital government services and not in the business owner’s pocket,” Acting DA Singas said. “Businesses that don’t remit sales tax money are stealing from the state, the county and their customers.’

Acting DA Singas said that Donnelly, as the responsible party for Mineola-Jericho Auto Body Inc., Trinity Auto Body, Ltd., and Trinity’s Mineola Jericho Auto Body Ltd., failed to file New York State tax returns and/or underreported sales in tax returns submitted on behalf of the three corporations from March 1, 2008 to Feb. 28, 2014.

The NYS Department of Taxation and Finance reviewed extensive records for all three companies and found additional monies that were not accounted for in their quarterly sales tax filings. The agency also found quarters for which tax returns were never filed.

DA investigators subsequently confirmed that the three companies and their responsible party were significantly underreporting gross sales.

Donnelly, acting as the responsible party for all three corporations from March 1, 2008 to February 28, 2014, failed to remit a total of $188,198.93 of collected sales tax.

Levittown Driver Pleads Guilty to High Speed, Alcohol-Fueled Crash on Northern State Parkway

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced a guilty plea in a case involving a drunk driver who killed his 23-year-old passenger in a crash that occurred at a speed of 120 miles per hour on the Northern State Parkway in July 2014.

Brian Friedrichs, 23, of Levittown, pleaded guilty today to the top charge he faced, Manslaughter in the 2nd Degree (a C felony), before Nassau County Court of Claims Judge Alan Honorof. He also pleaded guilty today to Driving While Intoxicated (an unclassified misdemeanor).

Friedrichs received a sentencing commitment from Judge Honorof of four to 12 years in prison. He is due back in court for sentencing on May 18.

“This defendant’s reckless actions resulted in the senseless death of his passenger, Christopher Gallina. And by driving drunk on a Nassau parkway at 120 mph, it is a miracle that many more lives were not lost,” Acting DA Singas said. “It reminds us how dangerous ‘first time’ DWI offenders can be and demonstrates why Aggravated Vehicular Homicide should be expanded to include grossly reckless drivers like Mr. Friedrichs.”

Acting DA Singas said that on July 22 at approximately 4 a.m., a 2012 Mazda 3 operated by Friedrichs with a 23-year-old passenger crashed while traveling westbound on the Northern State Parkway near the Post Avenue exit. Both Friedrichs and the passenger were ejected from the vehicle after it struck a wall on the shoulder and rolled.

The highest charge he faced was Manslaughter in the 2nd Degree, a C felony with a sentence range between probation and five to 15 years in prison. If the B felony of Aggravated Vehicular Homicide were expanded, Friedrichs would have faced a possible maximum sentence of 8-1/3 to 25 years in prison. Acting DA Singas’ office will be working with our legislative partners over the next few weeks to introduce legislation that adds a new subsection to Aggravated Vehicular Homicide making it a B felony to cause the death of someone while driving while under the influence of alcohol or drugs and when the driving is so reckless it creates a grave risk of death to others.

The black box contained within the defendant’s vehicle indicated that the vehicle was traveling 120 miles per hour before losing control. Friedrichs was arrested the same day by the New York State Police, with a blood alcohol content of .14%.

Acting DA Singas Urges Public to Remain Vigilant During Passover & Easter Holidays

Reminds residents to call 911 if they see suspicious behavior or packages; encourages victims of hate crimes to come forward

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas asked members of the public to continue to be the “eyes and ears” of law enforcement during the upcoming Passover and Easter holiday season, and encouraged victims of hate crimes to come forward and report those crimes to the DA’s office.

"Unfortunately, Nassau County is not immune from the dangers posed by terrorism and hate crimes that plague modern society,” Acting DA Singas said. “During this busy holiday season, I urge members of the public to take these threats to public safety seriously and to report any suspicious activity to law enforcement immediately.”

Though no specific terrorist threat has been reported in Nassau County, law enforcement officials are stepping up their patrols during the Easter and Passover season around places of worship and other places where a large number of people congregate. Residents are urged to call 911 if they witness suspicious behavior or see a package, box, or bag left unattended.

Acting DA Singas pointed to recent reports of hate crimes targeting members of Nassau’s increasingly diverse religious and ethnic communities as another reason for everyone to remain vigilant.

"Hate crimes will not be tolerated in Nassau County. My office will continue to investigate reports of bias crimes made against individuals or groups to ensure that our communities remain safe and inviting places for all,” Acting DA Singas said.

Acting DA Singas Announces Full Deployment of Body and Dashboard Cameras for Freeport PD

FREEPORT, N.Y. – Acting Nassau County District Attorney Madeline Singas joined members of the Freeport Police Department today to announce the full deployment of a body and in-car camera program to include every police officer on patrol, and every marked police vehicle on the road.

The program is being funded through the use of $108,000 in asset forfeiture funds obtained through the DA office's prosecutions of drug, gang, and other criminal cases.

“This groundbreaking crime-fighting program will have a positive impact for the hardworking police officers who patrol our streets every day, and for the people they are sworn to protect,” Acting DA Singas said.

“Whether it's providing better policing or helping crime victims, these cameras have been proven to be a valuable tool for our police officers,” said Freeport Police Department Chief Miguel Bermudez. “I want to thank Acting DA Singas for helping us fully utilize this valuable crime-fighting technology to protect our officers and better serve our communities.”

The full deployment of body camera technology will cover all Freeport police officers on patrol. The body cameras are cigar-shaped devices that are visibly worn under an officer's epaulet at shoulder level, and are activated by officers by pressing a button located at the officer's belt or shirt pocket.

Funds from the DA's office will also be used to install dashboard-mounted camera systems in all 16 of Freeport's marked police vehicles, as well as four unmarked vehicles. In-car camera systems are automatically activated whenever he overhead police lights are turned on.

Body and in-car camera systems operate on a 30-second loop – meaning that once an officer activates the camera system, 30 seconds of video has already been recorded, providing valuable footage in often fast-moving police encounters. Footage from the cameras will be securely stored for 120 days.

Some of the benefits of mobile and body cameras to law enforcement are:

• Recording victims' injuries and statements
• Documenting defendants' actions at the time of arrest• Evidence gathering at crime scenes
• Allowing juries to see and hear an event from an officer's perspective at the scene• Recording victims' injuries and statements

A report from the year-long implementation of these cameras in a similar-sized police department in Rialto, California in 2012 found a more than a 50 percent reduction in the total number of incidents of use of force by the officers using cameras compared to the control group that did not. Significantly, there were also nearly 10 times more citizen complaints in the 12 months prior to the experiment.

To help provide additional protection for officers, Acting DA Singas also announced today the funding of heavy-duty vests to be used by Freeport PD's Tactical Team to protect officers responding to some of the most dangerous crime scenes in Nassau County.

Former Employee and Her Husband Arrested for Stealing $200K in Goods and Services from Syosset Online Retailer

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced the arrest of an Oceanside couple for participating in a scheme to steal thousands in merchandise and shipping costs from a Syosset online retailer and selling the company’s goods and services as if they were their own.

Drew Reminick, 29, was arrested today and arraigned on charges of Grand Larceny in the 2nd Degree (a C felony) and Scheme to Defraud in the 1st Degree (an E felony) before Nassau District Court Judge Paul Meli, who set bail at $5,000 bond or $2,500 cash.

Ilana Kessler, also known as Ilana Kessler-Reminick, 29, was arrested and arraigned on March 19 on the same charges before Nassau District Court Judge Darlene Harris, who set bail at $5,000 bond or $2,500 cash. Both defendants are due back in court on April 24

If convicted of the top charge, the defendants each face a maximum sentence of five to 15 years in prison.

“Retailers rely on their employees to be honest ambassadors of their company to the customers that keep them in business,” Acting DA Singas said. “When employees attempt to capitalize on that relationship for their own personal gain, everyone – including customers, fellow employees and business owners – is hurt by their criminal conduct.”

Acting DA Singas said that ArmorMount LLC, an online store located in Syosset selling flat panel television wall mounts, employed Kessler in a contracted sales management capacity. From 2012 to 2014, with the assistance of her husband, Drew Reminick, Kessler allegedly stole merchandise from her employer during the course of her employment. The couple would then sell the stolen items through multiple methods, including on eBay.

After discovering a series of illegitimate transactions and thefts, ArmorMount filed a complaint to the DA office’s Criminal Complaint Unit.

The DA office’s subsequent investigation showed that a substantial amount of transactions were fulfilled using merchandise stolen from ArmorMount, for which the retailer was also billed for shipping, resulting in over $200,000 in losses.

Assistant District Attorneys Brian Heid and April Montgomery are prosecuting the case for Acting DA Singas’ Economic Crimes Bureau. Kessler is represented by Kyce Siddiqi, Esq.; Reminick is represented by David Mirsky, Esq.

Rockville Centre Financial Planner Pleads Guilty to Stealing Over $1.7 Million from Camp for Special Needs Children and Two Seniors

Drew Morgan, 44, is expected to serve prison time and be ordered to pay full restitution to Camp A.N.C.H.O.R. and former investment clients

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced that a Rockville Centre man pleaded guilty today to embezzling nearly $1.3 million from two nonprofits that raise money for special needs children and $475,000 from two sisters for whom he acted as financial planner.

Drew Morgan, 44, pleaded guilty today to Grand Larceny in the 1st Degree (a B felony) before New York State Court of Claims Judge Philip Grella. Morgan received a sentencing commitment of 3-1/3 to 10 years in prison, and is expected to be ordered to pay full restitution to his victims. He is due back in court for sentencing on May 22.

“Drew Morgan used his position as treasurer and president of two nonprofit organizations to steal money that should have been used to enrich the lives of children and adults with special needs,” Acting DA Singas said. “But those were not his only victims. The two sisters who handed over their money to a trusted advisor, only to have it stolen from them, are to be commended for helping to bring Mr. Morgan to justice.”

Acting DA Singas said that from February 2008 through January 2013, Morgan embezzled $1,159,953 from the Anchor Building Fund, Inc. while acting as its treasurer and a board member by using his position to withdraw cash from the fund’s accounts without authorization. This fund was maintained by Anchor Program Fund, Inc., the not-for-profit corporation that runs Camp A.N.C.H.O.R. (Answering the Needs of Citizens with Handicaps through Organized Recreation) in conjunction with the Town of Hempstead. This year-round recreation program serves children and adults with special needs.

Morgan stole an additional $130,558 between June 2010 and December 2012 from the Corporation for Socially and Exceptionally Challenged Kids, a non-profit corporation that was created in order to raise money for Camp A.N.C.H.O.R. and Impact OASIS. Morgan served as the corporation’s president and treasurer when he withdrew money from the corporation’s accounts without authorization. Impact OASIS is an organization that promotes the acceptance and inclusion of autistic individuals by establishing farming centers to promote healthy employment, housing, and community interaction.

These two thefts were uncovered by DA Investigators while examining Morgan’s bank records during a separate investigation into the theft of $475,000 from two sisters, age 69 and 70, for whom Morgan was working as a financial planner. Morgan, the principal of DKM Financial Corp. and owner of Rockstead Venture Capital LLC, is charged with stealing $250,000 that was supposed to be invested for a client between October 2008 and January 2010 and stealing $225,000 that was supposed to be invested for her sister between April 2008 and January 2010. In both cases, Morgan kept the money for himself.

Morgan used the stolen money to pay for a membership in the Hempstead Golf Club, airline travel and hotel stays, restaurants, credit and debit card purchases, appliances, home furnishings and personal expenses such as groceries and gasoline.

Morgan was arrested by DA investigators on Oct. 2, 2013.

Acting DA Singas Announces Arrest of Glen Cove Woman for Stealing Over $30K from Undocumented Immigrants

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced the arrest of a Glen Cove woman for stealing over $30,000 in savings from participants of a savings club commonly known in the El Salvadorian community as a “Cuchubal.”

Norma Espinoza, 37, was arrested today by the Glen Cove Police Department and arraigned on the following charges:

• Three counts of Grand Larceny in the 3rd Degree (a D felony)
• Two counts of Grand Larceny in the 4th Degree (an E felony)• Scheme to Defraud in the 1st Degree (an E felony)

Nassau District Court Judge Joseph Girardi set bail at $5,000 cash or bond. If convicted of the top charge, Espinoza faces 2-1/3 to seven years in prison. She is due back in court on March 20.

“This defendant is charged with taking the hard-earned money of immigrants by convincing them that the only way they could claim a small piece of the American Dream was to participate in her savings club scheme,” Acting DA Singas said. “$30,000 is a tremendous amount of money for these workers to lose. This type of crime is precisely why I announced my office’s new initiative to encourage immigrant victims and witnesses to work with law enforcement to help solve crimes against all Nassau County residents. Criminals who prey on the vulnerable will be prosecuted.”

Acting DA Singas said that in April 2012, Espinoza began a savings club commonly known as a “Cuchubal” among immigrants from El Salvador. This Cuchubal consisted of a group of undocumented immigrants who came together and made regular $200 weekly cash contributions to a common fund, which Espinoza agreed to maintain and disburse as a lump sum to each member on a rotating basis on a certain date.

Although interest was not paid on the monies collected, and a member might receive an amount greater than he or she had contributed as of the date that payment was received, the payments were made to the member with the understanding that the member would continue to make contributions that would enable other members to receive funds at a later date in the promised amount.

Espinoza enticed members of the El Salvadorian community to join the club by explaining to them that, as undocumented immigrants without social security numbers, they would be unable to open a bank account. Each member would contribute $200 in cash per week for one year. Each member would be assigned a month that they would be able to “withdraw” $10,400, and Espinoza would act as the “banker.” She handed out a list of all the members of the Cuchubal to each member, which included the dates that they would be able to make the withdrawals.

However, when the time came for the members to “withdraw” their funds according to the schedule that Espinoza had given them, she would offer various excuses for not making the promised payments. Although two of the members were able to obtain a partial payment after they went to Espinoza’s Glen Cove home and demanded full payment of the promised funds, other members did not receive any payments or refunds despite their demands for the same.

Members of the savings club went to the Glen Cove Police Department, which conducted an investigation before referring the matter to Acting DA Singas’ office. A joint investigation was then conducted with resulted in Espinoza’s arrest today by members of Glen Cove PD.

As of this date, Espinoza has not refunded a total of $30,700 to the complainants, and has not accounted for the missing funds.

Assistant District Attorney Victoria Abad Curran of Acting DA Singas’ Government and Consumer Frauds Bureau is prosecuting the case. Espinoza is represented by Legal Aid of Nassau County.
