Roosevelt Man Found Guilty of Murder
Jury: Cabrera guilty of October 2006 murder of teen
MINEOLA, NY –Nassau County District Attorney Kathleen Rice announced Friday afternoon that a jury has convicted Davon Cabrera, 22, of Roosevelt, of Murder in the Second Degree in connection with the October 2006 shooting of Queens teen Kail Ferro, 17. The trial lasted for five days, before the jury took just six hours to convict Mr. Cabrera. He was also convicted of Criminal Possession of a Weapon in the Second and Third Degrees. He faces a maximum of 25 years-to-life in prison at his February 5 sentencing.
Rice says that on October 21, 2006, police officers responding to a 'shots fired' call on First Place, in Roosevelt, discovered the body of gunshot victim Kail Ferro. The subsequent investigation led homicide detectives to believe that the victim was shot in the back while trying to evade a then-unidentified individual following a daytime high school homecoming celebration. The perpetrator was later identified as Davon Cabrera. Rice said the victim and the defendant were the participants in a long-term dispute that eventually led to the murder. Two days prior to the shooting, the victim was assaulted with a gin bottle by the defendant.
An eyewitness to the shooting testified at trial to seeing the defendant commit the murder. Multiple witnesses testified to seeing the defendant leaving the scene immediately following the single gunshot.
Mr. Cabrera was arrested by detectives from the police department's homicide squad on March 6, 2007, in Raleigh, North Carolina. It is believed that Mr. Cabrera has relatives in the Raleigh area.
At the time of the murder, the victim was a graduate of Roosevelt High School and was enrolled in Nassau County Community College.
Assistant District Attorney Joseph LaRocca, of the DA's County Court Trial Bureau, is handling the case for the District Attorney's Office. Mr. Cabrera is being represented by Ray Baierlien, Esq., of Garden City.
