Hempstead Man Guilty of Manslaughter After Shooting His Girlfriend’s Father

Moore went to victim’s house after an argument and shot him on the front lawn

MINEOLA, NY - Nassau County District Attorney Kathleen Rice announced today that a Hempstead man has been convicted of manslaughter and weapons charges after fatally shooting his girlfriend’s father on the man’s front lawn last year.

It took a jury a day to convict Diquan Moore, 21, of Manslaughter in the First Degree and two counts of Criminal Possession of a Weapon in the Second Degree. He was acquitted of Murder in the Second Degree. He faces up to 25 years in prison at his January 15 sentencing.

Rice said on the afternoon of September 1, 2008, the victim, Irving Simmons, and his wife went to Moore’s home to look for their daughter, who was dating Moore. The two have an infant son together. Simmons’ daughter had taken his wife’s minivan and had not returned when she said she would.

When Simmons and his wife arrived at Moore’s home, they saw Moore at the wheel of the minivan. Moore told the victim that his daughter had left the minivan in the middle of the street and that he was moving it. Moore then got out of the vehicle and moved to the passenger seat to remove his son, who seated in the back seat of the vehicle. When the victim and his wife stopped Moore from retrieving the child and demanded to know where their daughter was, Moore responded by cursing at the couple and threatening them.

Moore went to the victim’s home a short time later armed with a handgun. Moore fired two shots at the victim who was standing on his front lawn, hitting him once in the chest. Moore fled the scene on foot and was captured three weeks later in Baldwin.
