DILLON ANNOUNCES:
SENTENCING IN CASE OF LYNBROOK MURDER
Nassau County District Attorney Denis Dillon announced today that Janny Paez, 21, of 44 Nassau Avenue, Freeport was sentenced to 15 years to life by Nassau County Court Judge Jerald Carter. Paez pled guilty on February 15, 2005 to Murder in the Second Degree (felony), a Class A Felony.
According to Dillon, "On September 19, 2003 Marina Musso drove the get away car for four individuals, Nelson Zuniga, Omar DeLarosa, Janny Paez and Fernando Moronta, in the robbery of two Rockville Centre residents. Just three hours later, Musso again drove the get away car for Zuniga, DeLarosa, Paez and Moronta, after they brutally murdered Anthony Battaglia just steps from his Lynbrook home. Battaglia was on his way home from the Lynbrook train station when he was beaten, then stabbed by DeLarosa and ultimately shot by Zuniga. The victim was pronounced dead at the scene."
Nelson Zuniga, 21, of 155 Pine Street, Freeport was sentenced on August 16, 2005 to 70 years to life in prison by Nassau County Court Judge Jerald Carter. On July 13, 2005, Zuniga was found guilty after trial of two counts of Murder in the Second Degree (felony and intentional), Class A Felonies, 4 counts of Robbery in the First Degree, Class B Violent Felonies and 2 counts of Attempted Robbery in the First Degree, Class C Felonies.
Omar Delarosa, 20, of 49 Lillian Avenue, Freeport was sentenced to 23 years to life in prison by Nassau County Court Judge Jerald Carter on August 22, 2005. Delarosa pled guilty to the top count of Murder in the First Degree, a Class A Felony on June 3, 2005.
Marina Musso, 23, of 794 Long Beach Avenue, Freeport pled guilty to Robbery in the First Degree, a Class B Felony and Attempted Robbery in the First Degree, a Class C Felony on January 21, 2005. Musso is scheduled to be sentenced on September 15, 2005.
Fernando Moronta 21, of 85 North Long Beach Avenue, Freeport, pled guilty on February 8, 2005 to Robbery in the First Degree, a Class B Violent Felony and Attempted Robbery in the First Degree, a Class C Violent Felony. Moronta was sentenced to a 10 year determinate sentence and 5 years post release supervision by Judge Carter on August 1, 2005.
