Small Petroleum Tank Enforcement Policy
A policy with regard to Article XI is necessary to be consistent with recent changes to the State Petroleum Bulk Storage Law. In order to be consistent with State Law and to encourage owners of small tanks to replace them as quickly as possible, the Nassau County Board of Health hereby adopts the following policy:
It shall be the policy of the Nassau County Board of Health and the Nassau County Department of Health that individual fuel oil storage tanks with a capacity of 1100 gallons or less, and tanks interconnected or connected to the same heating equipment with a combined capacity of 1100 gallons or less shall be exempt from the following Article XI requirements: secondary containment, registration, permits, fees, plan review, upgrading, replacement schedule, and testing schedule. Existing tanks will continue to be subject to Article XI regulations when they are replaced, abandoned, removed, fail, or leak. In addition, new underground fuel oil tanks with a capacity of 1100 gallons or less must be constructed of single-walled fiberglass as a minimum and tested before being placed in service. New aboveground fuel oil tanks with a capacity of 1000 gallons or less must be installed on a concrete pad with overfill protection, proper venting, and a gauge. This policy does not include waste oils used as heating fuels.
Abandonment in Place/Removal of a Tank
As of January 1, 2007 the fees for recording and/or witnessing an abandonment in place or removal of a tank (including the filing of the affirmation of a nonleaking heating oil tank) shall be as follows:
