New Cassel Man Found Guilty of Murdering Wife
Toxtle stabbed wife multiple times after she admitted affair
MINEOLA, NY – Nassau County District Attorney Kathleen Rice announced today that a jury has convicted Jose Toxtle of murdering his wife, Teresa Barrera, 42, in their New Cassel apartment after she revealed she had been having an affair with another man and told him he had a small penis.
A jury took about four hours to find Toxtle, 43, guilty of Murder in the Second Degree. Toxtle was arrested December 11, 2007 after he called 911 to report the attack. Police recovered a four-inch knife at the scene and Toxtle later confessed to the crime during a videotaped interview with prosecutors. He is scheduled to be sentenced July 22, and faces 25 years to life in prison.
Rice said that Toxtle stabbed his wife multiple times in the chest and torso after she confessed to having an affair. Barrera also told the defendant that he had a small penis and that he couldn’t satisfy her sexually. “Mr. Toxtle chose to settle his marital problems with violence and now he will suffer the consequences of his actions.”
During the four-day trial, the defense argued that Toxtle was in a state of extreme emotional disturbance after his wife admitted the affair and that he shouldn’t be held responsible for the murder.
