About The Program

If you were present at the Valley Stream Wal-Mart Store on the morning of November 28, 2008 between 2:30AM and 6:00AM and, as a result of the crowd-related events that occurred during that time period, you suffered personal injuries or property damage, you may be eligible to receive payment for your out-of-pocket losses or damages. A Recovery Fund has been jointly established by the Nassau County District Attorneys’ Office and Wal-Mart Stores, Inc. to enable you to resolve your claims quickly, while avoiding costly and lengthy civil litigation.

This program is optional. If you choose not to participate in the program, you are free to pursue any legal remedies separately in court.

To participate, you must provide evidence of your claim. You will be required to complete a sworn Claimant’s Affidavit describing your claimed losses and/or damages and provide any documentation you have to support your claim.

This program is time-sensitive. Your claim must be postmarked no later than June 20, 2009. Unfortunately, we cannot allow exceptions to this time limit. If your claim is late, you will not be able to participate in this program, but you will still be able to pursue your claim separately in court.

 


How It Works

After successfully submitting your claim, a Claims Representative will examine everything you have submitted and determine whether you are entitled to any awards. Note that merely submitting a claim does not guarantee that you will receive money, as each claim will be evaluated individually. No claim will be approved for payment unless your Claimant’s Affidavit, along with any additional proof you submit, is determined to be credible.

If your claim is approved, you will receive a Notice of Remuneration Award (for out-of-pocket losses) and/or a Notice of Compensation Award (for other losses or damages). These notices will inform you of the monetary award that you will receive if you choose to participate in the program.

If you are not happy with the award you are offered, you may reject it and pursue your claim civilly. If you do wish to receive the award, you will be required to sign a General Release of Claims. By signing this document, you will agree to release any claims that you may have against Wal-Mart relating to the crowd-related events at Valley Stream. Once you complete and return the General Release of Claims, a check for your award will be mailed to you within two weeks of the day it is received.

Please note that no part of this program, including your receipt of a financial award, can be construed as an admission of guilt by Wal-Mart in any way. For more information, please read the “Questions” section below.
