Elsa Marina Saravia-Martinez, 36, was convicted by a jury of Assault in the 1st Degree (a B violent felony) and Criminal Possession of a Weapon in the 4th Degree (an A misdemeanor). The defendant is due back before Court of Claims Judge Robert Schwartz on May 2 and faces a maximum sentence of up to five to 25 years in prison. The trial lasted for three days and the jury deliberated for four hours.

“This defendant brutally stabbed her ex-boyfriend in the stomach causing life-threatening injuries,” DA Singas said. “Thanks to the efforts of the Nassau County Police Department and our prosecution team, she will be held accountable for this senseless violence.”

DA Singas said on July 5, 2015, at approximately 3:15 a.m., the defendant stabbed her ex-boyfriend in the stomach with a 12-inch kitchen knife while inside La Miranda River Café, a bar in Hempstead. The defendant was working as a cook and the victim was patronizing the bar at the time of the stabbing. The victim was transported to Winthrop University Hospital by the bar owner and suffered a laceration to his bowel which required immediate surgery to repair. He has since fully recovered from his injuries but has lingering scars.

Following the stabbing, the defendant remained at the bar, finished her shift and went home at the end of the night. She was arrested by NCPD 3rd Squad detectives 12 hours later at her apartment in Hempstead. During the trial, the defendant claimed her actions were self-defense.

Assistant District Attorney Rachael Whalen of DA Singas’ County Court Trial Bureau is prosecuting the case. Saravia-Martinez is represented by Andrew Monteleone, Esq.
