[ARCHIVED] Amityville Man Indicted for Burglarizing Garden City Home

Nervon Gayles stole two cellphones and police were able to track him down through Find My iPhone app

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced the indictment today of an Amityville man who allegedly broke into a Garden City home at 3 a.m. on June 10 and stole two iPhones and a Sony PlayStation.

Nervon Gayles, 21, was arraigned before Acting Supreme Court Justice David Sullivan on one count of Burglary in the 2nd Degree (a C violent felony) and one count of Criminal Possession of Stolen Property in the 5th Degree (an A misdemeanor).

Judge Sullivan continued bail at $30,000 bond or $17,500 cash. If convicted of the top charge, Gayles faces a maximum of 3 ½ to 15 years in prison. He is due back in court on Nov. 17.

“The defendant is alleged to have brazenly entered a home while a family was sleeping and stole their possessions, including two cellphones,” Acting DA Singas said. “Thanks to advances in technology, our partners in law enforcement were able to track down the defendant and arrest him.”

Acting DA Singas said that on June 10, Gayles unlawfully entered a Garden City home through a rear door while the family was sleeping. The defendant took an iPhone 5, iPhone 6, Sony PlayStation, and a pocketbook from inside the house. Gayles left the home, discarded the pocketbook at a nearby location and went to a Hempstead property. When the family woke up and discovered the items were missing, a person called 911.

Garden City Police Department and Nassau County Police Department personnel used the “Find My iPhone” app to track the defendant down to a location in Hempstead. When the defendant exited the property, he was carrying a shopping bag with the stolen PlayStation and one of the iPhones on his person and was subsequently arrested.

Assistant District Attorney Ilyssa Spergel of Acting DA Singas’ County Court Trial Bureau is prosecuting the case. Gayles is represented by Nancy Garber, Esq.

The charges are merely accusations and the defendant is presumed innocent until and unless found guilty.
