Tyshaun Phillips, 23, opened fire into a crowd, killing a college student

Mineola, NY – Nassau County District Attorney Madeline Singas announced today that a Bronx man was sentenced to 23 years in prison for a 2014 fatal nightclub shooting in Garden City.

Tyshaun Phillips, 23, pleaded guilty on June 6 before Supreme Court Judge William Donnino to charges of manslaughter in the first degree (a B violent felony) and assault in the first degree (a B violent felony).

“This defendant terrorized a packed nightclub and killed an innocent young man when he wildly shot into the crowd after a fight,” DA Singas said. “Emmanuel Barnett was a promising electrical engineering student at Queensborough Community College when his life was tragically cut short by Phillips and I hope that this sentence will bring a measure of comfort to his family.”

DA Singas said on March 16, 2014 at about 3:30 a.m., Phillips was part of a crowd thrown out of Mint Nightclub after a large fight broke out. The defendant then came back into the vestibule area of the club armed with a .40 caliber handgun and shot the weapon several times into a crowded area, striking two people. Phillips was later identified by witnesses who were present at the shooting.

Emmanuel Barnett, 21, was shot in the head and died at Winthrop-University Hospital on March 21, after being on life support. The second victim was shot in the leg and survived.

Phillips was on parole for a 2011 felony drug conviction in Queens County and was arrested at a parole office in the Bronx by Nassau County Police homicide detectives on March 26, 2014 for the crime.
